Right to Education (RTE) Will Not be Affected by Court Notice

New Delhi: On Wednesday i.e. March 24, 2010, Human Resource Development (HRD) Kapil Sibal announced that the Supreme Court’s notice issued to Human Resource Development (HRD) ministry over some provisions of the Right To Education (RTE) Act will not affect its implementation from April this year.
 
During the Indian Women's Press Corps, Mr Sibal said that the HRD ministry has not got the notice yet and he will reply accordingly. Everybody has a right to challenge the government. The court will decide. Anyhow, the implementation of the act will not be affected by it.
 
As per sources, the court on Monday i.e. March 22, 2010 has issued notice to the ministry, on a petition challenging the Right to Free and Compulsory Education Act, also known as Right To Education (RTE), as being unconstitutional and against the fundamental rights of unaided private educational institutions.
 
Further, under the RTE Act, free and compulsory education has been made a fundamental right for children between 6-14 years. It has mandated that even private educational institutions have to reserve 25 per cent of the seats for children from poor families.
